Notice is hereby given that Borough Council of the Borough of Strasburg, Lancaster County, Pennsylvania, at its regular public meeting on Tuesday, September 8, 2020, at 7:30 p.m., at the Strasburg Borough Municipal Building, 145 Precision Avenue, Strasburg, Pennsylvania, shall conduct a public hearing on and, at the conclusion of the public hearing, shall consider and, if appropriate, at that meeting, or at a subsequent public meeting held within 60 days of the date of publication of the final publication of this advertisement, if deemed appropriate by Borough Council, shall enact an ordinance, the caption of which is as follows:

AN ORDINANCE TO AMEND THE STRASBURG BOROUGH ZONING ORDINANCE OF 1993 TO REVISE AND ADD DEFINITIONS; TO REVISE PERMITTED AND SPECIAL EXCEPTION USES IN THE COMMERCIAL ZONE (C-1), HIGHWAY COMMERCIAL ZONE (C-2), AND THE RESTRICTED COMMERCIAL ZONE (C-3); TO REVISE PERMITTED, SPECIAL EXCEPTION, AND CONDITIONAL USES IN THE INDUSTRIAL ZONE (I); TO REVISE REGULATIONS UNDER THE GATEWAY NORTH OVERLAY ZONE (GN); TO REVISE THE TABLE UNDER SECTION 310.7 TO ADD ADDITIONAL USES TO THE PARKING REQUIREMENTS; TO RENAME SECTION 438 FROM TAVERNS TO RESTAURANTS, TAVERNS, BREWPUBS, AND WINE RETAIL/TASTING AND REVISE REGULATIONS THEREUNDER; AND TO ADD TWO NEW SECTIONS UNDER ARTICLE 4 TO PROVIDE SPECIFIC CRITERIA FOR USES RELATING TO MEDICAL MARIJUANA.

The proposed ordinance may be summarized as follows. Section 1 amends the Strasburg Borough Zoning Ordinance of 1993 (“Zoning Ordinance”) to add definitions for the terms brewery, brewpub, Liquor Code, medical marijuana, Medical Marijuana Act, medical marijuana dispensary, medical marijuana grower/processor, microbrewery and wine retail/tasting. Section 2 revises the definition of the term restaurant. Sections 3 and 4 remove restaurants as a permitted use and add restaurants, taverns, brewpubs and wine retail/tasting as special exception uses in the Commercial Zone (C-1). Sections 5 and 6 remove restaurants and taverns as permitted uses and add restaurants, taverns, brewpubs and wine retail/tasting and medical marijuana dispensaries as special exception uses in the Highway Commercial Zone (C-2). Sections 7 and 8 remove restaurants and taverns as permitted uses and add restaurants, taverns, brewpubs and wine retail/tasting as special exception uses in the Restricted Commercial Zone (C-3). Sections 9, 10 and 11 exclude microbreweries as a permitted use, add medical marijuana grower/processors as a special exception use and add microbreweries as a conditional use in the Industrial Zone (I). Section 12 amends Section 211.2 to limit circumstances in which the provisions of the Gateway
North Overlay Zone (GN) may be elected by an applicant. Sections 13 and 14 remove restaurants and similar establishments and exclude retail sales of wine as permitted uses in the Gateway North Overlay Zone (GN). Section 15 adds taverns, brewpubs and wine retail/tasting to the off-street parking requirements applicable to restaurants. Section 16 amends Section 438 imposing criteria for special exception approval of restaurants to add taverns, brewpubs and wine retail/tasting. Section 17 adds Sections 448 and 449 which impose criteria for approval of medical marijuana grower/processors and medical marijuana dispensaries. Sections 18-20 reaffirm all other parts and provisions of the Zoning Ordinance, provide for the severability of any invalid provisions, and establish the effective date of the proposed ordinance. A copy of the proposed ordinance may be examined without charge at the offices of this newspaper, at the Lancaster County Law Library, and at the Strasburg Borough Municipal Building, 145 Precision Avenue, Strasburg, Pennsylvania, Mondays through Fridays from 7:30 a.m. until 4:00 p.m., except holidays. A copy of the proposed ordinance may be obtained for the cost of reproduction at the Strasburg Borough Municipal Building during the above hours.
